Unless otherwise indicated, all design and content featured on this Website — including but not limited to text, graphics, logos, icons, images, artwork, audio and video clips, and software — is the exclusive property of Classy Cut or is used under a valid license granted to Classy Cut. All rights are reserved.

4. Conditions of Sale

Classy Cut reserves the right to modify retail prices displayed on the Platform at any time without prior notice.

4.1 Live Metal Pricing — Gold and Silver Coins

Metal prices for gold and silver coins are sourced from a live pricing API and are automatically updated on the Website every two (2) hours. As a result, prices are subject to frequent fluctuation. Classy Cut reserves the right to reject or cancel any order for gold or silver coins in the event that the applicable metal price changes between the time of order placement and order confirmation, or in the event that the product is out of stock at the time of processing.

Please Note: For the most accurate and up-to-date pricing on gold and silver coins, we strongly recommend speaking with one of our product experts prior to placing your order.

5. Use of Materials on the Platform

Classy Cut maintains its Platforms to provide information about its products and services for your personal, non-commercial use. While considerable effort has been made to ensure that product images accurately represent the colour, design, and style of original products, minor variations, distortions, or discrepancies may exist due to technical factors such as browser settings or display configurations. Classy Cut shall not be held liable for any such visual discrepancies between product images displayed on the Platform and the actual products.

Some items may appear larger or smaller than their actual size due to screen defaults and photography techniques. Product dimensions and metal weights specified in product listings may vary from the actual product. The diamond carat weight stated in product details may vary by ten to fifteen percent (10–15%) from the actual product.

6. Custom Jewellery

By submitting a custom jewellery design ("Custom Design"), you represent and warrant that: (i) the design is entirely your own and does not belong to any third party; and (ii) the design does not infringe upon any intellectual property rights, including trademarks or copyrights, held by others.

Upon submission of payment to initiate a custom design draft, the design charge is non-refundable. Custom jewellery orders will only be processed upon receipt of full payment and confirmation from our payment gateway partners. Custom jewellery orders may be exchanged or upgraded, subject to availability and at our discretion. No refunds will be issued for custom jewellery orders. Alternatively, you may apply the equivalent value toward any other product of equal or greater price.

7. Diamond Certificates

All loose diamonds are shipped with an accompanying diamond grading report issued by a recognised diamond grading laboratory. As replacement of these reports is costly, the grading report must be included with any returned diamond. Failure to return the grading report will result in a replacement fee of USD $150 (or the equivalent amount in the applicable local currency).

8. Jewellery Certificates

Classy Cut provides a jewellery certificate with every jewellery product. However, all certificates are issued by independent third-party certification bodies. Classy Cut does not issue its own certificates and, accordingly, accepts no liability for any errors, omissions, or issues arising in connection with third-party certificates. No legal action may be brought against Classy Cut in relation to any jewellery certification matter.

9. Product Descriptions

Classy Cut makes all reasonable efforts to accurately represent products listed on the Website. However, due to variations in monitor display settings and colour rendering, Classy Cut cannot guarantee the accuracy of product colour, texture, or detail as displayed on your screen. Product descriptions are provided in good faith but are not warranted to be complete, accurate, or error-free.

In the event that a product is incorrectly priced, Classy Cut reserves the right to refuse the sale or, if payment has already been finalised, to cancel the order and issue a full refund. If a product is not as described, your sole remedy shall be to return the item in unused and original condition.

10. Diamond Damage or Loss Post-Delivery

Classy Cut shall not be held liable for any damage to or loss of a diamond occurring after delivery. All products are thoroughly inspected and verified prior to shipment. Any costs associated with remaking or repairing jewellery following post-delivery damage shall be borne solely by the customer.

11. Errors, Corrections, and Changes

Classy Cut does not warrant that the Website will be error-free, free of viruses or other harmful components, or that defects will be corrected. We reserve the right to modify the features, functionality, or content of the Website at any time and to correct or remove any inaccuracies as they are identified. Classy Cut further reserves the right to edit or delete any documents, information, or other content appearing on the Website at its sole discretion.

12. Payments

By making a purchase, you represent and warrant that: (i) all payment information provided is true, complete, and accurate; (ii) charges incurred will be honoured by your card issuer; and (iii) you will pay all applicable charges, including taxes and shipping fees, at the prices posted at the time of purchase.

If you wish to make a part payment, you must notify us prior to initiating payment. No part payments will be accepted retroactively, and no refunds will be issued in connection with part payments.

Classy Cut shall not be liable for any compromised payment transactions, failed transactions, or amounts deducted from your account during the payment process. In the event of suspected payment fraud or compromise, Classy Cut reserves the right to block the relevant user account and withhold delivery or shipment of any associated order.

Orders may be cancelled within forty-eight (48) hours of placement for a full refund, provided the order has not yet been shipped. Cancellations made after forty-eight (48) hours will be subject to deductions in accordance with our Return and Refund Policy.

13. Retail Purchase Process

Members wishing to purchase items from the Website may do so by:

1. Adding a selected diamond directly to the shopping cart;
2. Customising jewellery by adding a diamond to a ring, pendant, earring, or other customisable item and proceeding to checkout; or
3. Selecting from the available jewellery range and adding the item to the shopping cart.

Members may be required to register on the Website prior to completing a purchase. Certain statutory details, including Permanent Account Number (PAN), GST number, or equivalent documentation, may be required at the time of purchase. International orders may require a tax identification number or equivalent documentation for shipping and compliance purposes.

Orders are considered confirmed only upon receipt of full payment by classycutsstones.com. Classy Cut may conduct random verification calls to confirm orders prior to dispatch. Orders will be processed and shipped only following successful verification and payment confirmation. In the event that a payment transaction is declined by the issuing bank, Classy Cut reserves the right to withhold shipment of the order without liability.

14. Dispute Resolution

Any dispute arising out of or in connection with these Terms of Use shall first be subject to good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation, it shall be referred to and finally resolved by a court of competent jurisdiction located in Mumbai, Maharashtra, India.

15. Severability

If any provision of these Terms of Use is found by a court of competent jurisdiction to be unlawful, void, or unenforceable, such provision shall be deemed severed from these Terms of Use without affecting the validity and enforceability of the remaining provisions.

16. General Provisions

No joint venture, partnership, employment, or agency relationship is created between you and classycutsstones.com by virtue of these Terms of Use or your use of the Website. The failure of Classy Cut to enforce any right or provision under these Terms of Use shall not constitute a waiver of such right or provision with respect to any subsequent or other breach or default.

All rights not expressly granted under these Terms of Use are reserved by Classy Cut. All trademarks, product names, and company names and logos appearing on classycutsstones.com, other than those of Classy Cut, are the property of their respective owners.
